The process for a Statement or affidavit of concurrence (SOC)

If the Insolvency Practitioner requires a party to concur with the Statement of Affairs they must inform the person completing the SOA of the request.

The preparer must then deliver a copy of the Statement of Affairs to the person required to concur with it.

The party requested to concur with the Statement of Affairs then has 5 business days from receipt (including date of receipt) to submit the original and a copy Statement of Concurrence to the Insolvency Practitioner (IP).  The IP has the power to extend the deadline but this should only be done in exceptional circumstances.

The Statement of Concurrence is filed at Companies by the Insolvency Practitioner.
